TRAI issues consultation paper on data ownership, privacy and security

The Telecom Regulatory Authority of India (TRAI) has floated a consultation paper that aims to identify key issues pertaining to data protection with the respect to digital services, devices, networks and applications. The consultation process will also assess whether the data rights of mobile phone users are adequately protected.

The paper has questions aimed at identifying the scope and definition of personal data, and ownership and control of data,  and assessing the adequacy and efficiency of data protection measures currently in place. The comments on such key issues have been sought by September 8, 2017 and counter-comments by September 22, 2017. The regulator subsequently plans to hold open-house discussions, following which it will make recommendations to the Department of Telecommunications (DoT), which will take a final call on implementation.

TRAI in its paper has acknowledged that the users should be empowered in respect of ownership and control of his/her personal data and to ensure this, all the players in the eco-system are bound to follow certain safeguards while collecting, storing and using the data pertaining to their subscribers.
